犯罪故意成立视野下的违法性认识

Illegal Cognition in Intention of Crime

违法性认识问题历来是刑法学界争论的焦点。在犯罪故意成立的视野范围内探讨违法性认识,应该从概念界定、构造和价值等方面进行,得出违法性认识是对行为违反法律规范或法律秩序的意识,即是行为形式违法性的认识,并且以直接、现实的认识为已足的结论,肯定违法性认识在犯罪故意中的价值。

Illegal cognition has been one of the points at issue in the science of criminal law. The author studies illegal cognition from three aspects： its determination, construction and value. He also draws the conclusion that illegal cognition is the one that the behavior is illegal and it is the direct and realistic cognition. In the end, the author affirms the value of illegal cognition in criminal intention.
