试论我国刑事强制措施的人权保障功能

On Our Country's Criminal Coercive Measure and the Protection of Human Right

刑事强制措施是公安司法机关在刑事诉讼过程中依法采取的限制或剥夺犯罪嫌疑人、被告人的人身自由的强制方法。对于刑事强制措施的制度设计应当从打击犯罪和保障人权的双重目的出发。

Criminal Coercive measure is an enforcing method that the public, security hureau for justice takes to limit or deprive the criminal suspect and defendant＇s personal liberty, whose design is on the basic need of attacking crime and protecting human right.
