摘要
刑事被害人补偿制度在我国立法中尚是空白,建立该制度必须探讨分析其得以建立的价值基础,即:促进公正与效率,保障人权和控制犯罪,强化国家责任和保护公众信赖利益以及增进社会福利。
The compensation system of the criminal injured party is still absent in the legislation of our country, this system must be set up, probing into and analyzing its value foundation, namely promoting fairness with efficiency ,ensuring human rights and controlling the crime , strengthening the state responsibility and protecting the public＇s interests of trusting and promoting the social welfare.
