摘要
随着住宅体制改革的深入,住宅产权问题不断地从各个角度被提出。在中国城镇住宅体制改革中,出售公有住宅、多渠道筹资建房,以及提高公有住宅租金水平,始终构成其最重要的三项内容。就出售现存公房以及新建的商品房来说,既然涉及买卖,买卖对象的性质以及买者对该对象所拥有的权利,无疑必须首先界定清楚。动员各方面的资金来建造住宅也是这样。如果投资者对投资对象的权利得不到保障,其投资的积极性绝不可能持久。甚至提租也回避不了住宅产权问题。因为,举凡提租所需的补贴资金来源、提租收入在政府和单位之间的分享,以及这些收入的使用等等问题,都需要在住宅产权界定清楚的基础上方能妥善解决。
Abstract As the reform of housing system is deepenig,the problem of housing property right is being raised from different levels.In the reform of China's urban housing system,there occur three forms of reforming:namely,the sales of public owned houses;the construction of new houses funded from multi-channels and the upgrading of public-owned house rent.No mater in the case of selling public owned houses or the constructing of new commodity houses the nature of the deal and the rights of sellers and buyers have to be undoubtedly defined first.It is also true in the case of construction new houses with different resources.If the rights of the investors can not be safeguard,the investment initiative can not endured. Even in the case of raising house rent,the property right problem can not be evaded. Because the source of subsisdies,the sharing of rent income between government and the units and the use of the rent income have to be settled properly on the basis of clearly defined property right of houses.
