Geographical Indication Protection of Traditional Crafts——taking Laifeng Painted Chopsticks as an Example

民族传统工艺的特点与地理标志的品质标示属性具有内在契合性,但中国该领域的地理标志保护现状不容乐观,地理标志保护的双轨制之间的矛盾是其制度上的根本原因。在中国现有的立法资源下,采取商标法和地理标志专门法共同保护的模式并完善相关制度是比较现实的做法。在运用地理标志保护民族传统工艺时应当以地理标志专门法保护为主导、简化传统工艺的地理标志商标申请授权手续并且明确质检部门和工商部门的职责范围。
