农村土地流转程序的正义性倡导土地流转过程的伦理性、交涉的正义性和结果评价的正当性。目前农村土地流转存在一些缺乏程序公开化、规范化、制度化的非正义表现,因此应要强调农村土地流转的交换程序的正义性,推进土地流转程序的公开化,增强土地流转程序的合理性,规范性,重构土地流转程序的制度体系,以促进社会主义新农村建设。

Rural land transaction requires the ethics of transaction process and the justice of negotiation as well as the legitimacy of consequence.The procedure of rural land transaction is complex and the procedural justice should be ensured.However,some injustice emerges in the procedure of rural land transaction at present.For example,there is a lack of procedural openness,standards,and institutionalization in rural land transaction in some places.To solve these problems,we should promote rural land transaction in order,emphasize the procedural justice of rural land transaction, expand the openness of rural land transaction procedure,emphasize the rationale and standards of rural land transaction and ensure the institutionalization of land transaction procedure.These will promote the construction of new socialist rural communities.
