Judicial legislation,as a special institution in Common Law countries,is complementary to the legislation and flexible in practice.It has nowadays gone beyond the civil law countries and become more and more popular all over the world.More and more law scholars come to research the judicial legislation,and they investigate its characteristics,reasons of its development,its limits and weakness.Finding the answers to these theoretical questions will help make rational use of judicial legislation which is beneficial to the law's unity and authority,and at the same time avoid abuse of the judicial power and its infringement to legislative power.
