我国现行立法对驰名商标在因特网上的法律规制还是一个法律上的空白。新兴技术给相对稳定的传统法律制度提出了极大的挑战。因特网的迅猛发展影响着驰名商标在因特网上的地位及其保护;我国驰名商标在因特网上与网络域名发生冲突时驰名商标胜诉一案启示颇多,有利于对立法的完善;我国驰名商标保护的现状、国际趋势,都要求对因特网上驰名商标进行特殊保护。
