公诉制度在维护统治阶级的利益和当事人的权益方面具有重要作用,而在我国行政诉讼中尚未确立行政公诉制度。阐释行政公诉制度的理论基础,分析我国目前行政诉讼中有关行政公诉的现状、缺陷,论证建立行政公诉制度的必要性,并提出立法的具体构想。

Public prosecution system plays an important role in safeguarding governmental interests and parties rights.China does not establish the administrative public prosecution system.This paper analyzes the theoretical basis of the administrative public prosecution system and analyzes its current situation and defects,demonstrates the necessity and puts forward some legislative suggestion.
