论我国刑法中“明知”的理解与适用

An Analysis of Reports about the New Rural Social Insurance ——Taking Reports on Xinhua Net as Sample Texts

我国刑法总则中的"明知"和分则中的"明知"含义不尽相同,总则中的"明知"规定对分则中的"明知"规定具有指导意义。犯罪故意中"明知"内容的判断标准宜采"认识符合说"。"明知"的具体内容应包括客观要件要素事实和客体要件要素事实。

The new rural social insurance is one of the important public welfare policies in China. Making use of the reports on the Xinhua Net as sample texts, this article makes an analysis of the contents of the reports about new rural social insurance. The result shows that the reports takes news as the major genre, that the contents are mainly about pilot areas, and that the time distribution of the reports are correlated to the changes of policies. To perfect the reports about rural social insurance, reporters should diversify the genres of the reports, enrich the contents and increase interactivity of reports.
