产品责任与生产者延伸责任研究

Research on Products Liability and EPR

产品责任和生产者延伸责任(EPR)均属于生产者责任范畴。产品责任旨在保护消费者权益,生产者延伸责任则关注环境保护。基于保护消费者权益,以缺陷产品是否投入流通领域,可以将产品责任分为两类,即进入流通领域前产品存在缺陷的产品责任和进入流通领域后发现产品缺陷的产品责任。基于环境保护,最初EPR要求生产者承担回收废弃产品义务,然而部分国家根据自身情况对EPR做出了修正。EPR在产品适用范围、责任人、承担责任前提、费用承担等方面不同于产品责任,有必要对产品责任与EPR进行研究,以便完善中国有关立法。

Products liability and extended producer responsibility(EPR) belong to the scope of producer responsibility.Products liability designs to protect the interests of consumers',and EPR is concerned about environmental protection.Based on protecting the interests of consumers',products liability can be divided into two categories,that is,products liability is found defective before and after the product has been put into circulation.Based on environmental protection,the initial EPR requires producers to bear the obligation of recycling the waste products,but appropriate amendments to EPR have been made in some countries according to their own situation.In the product scope,the responsible person,premise liability,cost and other fields,EPR is different from product liability,it is necessary to discuss product liability and EPR in order to improve the relevant legislation in China.
