房地产合作开发合同效力中的国家干预

摘要 我国的房地产合作开发合同内容庞杂、法律关系错综复杂、涉及的人员财产范围较为广泛,因此,国家不能对房地产合作开发合同听之任之,应以保护社会公共利益为目的,在保证当事人合同自由的前提下对合同予以适度的干预,对合同效力的干预是国家干预的一种手段。一个有效合同需要具备有效的因素,在合同出现无效因素时允许当事人通过一定的行为将合同补正为有效合同。从短期的角度来看效力补正制度存在合理性,但是从法治以及社会的长远利益来看,这种治标不治本的做法应该予以完善。 The cooperative development of real estate contract contains complex content,complex legal relationship,extensive staff and property.Therefore,the state can not turn a blind eye to the contracts,and should protect the public interests for the purpose of ensuring the freedom of contract under the premise of the parties of the contract to be appropriately intervened.The intervention of the effectiveness of the contract is a means of state intervention.The valid contract needs effective factors,and allows the parties of the contract corrected validity of contract through a certain behavior to revise the invalid contract to be the effective one.From the perspective of short-term,the effectiveness correction system is reasonable,but from the legal system and long-term interests of society,this palliative approach should be improved.
