试论新《破产法》的经济法价值取向——新《破产法（草案）》精神解读

About the Economic Iaw Value Orientation of the New Bankcrapcy Law

我国于1986年颁布的现行破产法已经不能适应新经济形势的需要,新<破产法(草案)>已经出台.将来的新破产法与现行破产法相比最大的特点是其明显的经济法价值取向.新破产法经济法价值取向主要表现在四个方面:赋予形式平等的法律关系主体不对等的权利义务;管理人制度的引入;破产司法权的扩大;个人利益和社会利益冲突的解决机制新取向.新破产法经济法价值取向的经济基础在于社会化大生产.社会化大生产使得破产关系不再是纯粹的私的经济关系.而有限责任制度的确立则是其经济法价值取向的制度上的原因.

The present bankruptcy law was promulgated in 1986. It is not able to meet the demamds of new economical situatiaon now. The new bankruptcy law draft has already been made. Compared the future new bankruptcy law with the present bankruptcy law, the author believes that the obvious difference of the future new bankruptcy law is rather in the economic law value orientation than that of the new bank- ruptcy law. The orientation mainly displays in four aspects： allocating different rights and duties to the le- gal relationship bodies, the supervisor system , the expansion of bankrupt jurisdiction as well as the solution to the conflict of the personal interest and the social benefit. The economic law value orientation of the new bankruptcy law lies in the socialized production. At the same time,the establishment of the limited liability system is also the important reason.
