Study on How to Protect the Intellectual Patent of Guizhou Ethnic Culture

贵州是一个边远的后发展民族地区,由于地理与历史的原因,民族文化传统知识非常丰富。在今天,随着现代社会工具理性的高杨,民族文化的传承与保护日益紧迫。一方面,民族文化传统知识已经以各种形式参与到社会经济发展的舞台,对地方经济可持续发展产生着重要的意义;另一方面,市场交易者在挖掘传统知识商业价值的同时,经常出于单方面利益的考虑而歪曲、割裂、甚至滥用传统知识,以至对传统知识背后特定的民族群体精神、尊严等造成伤害。知识产权是WTO重要的内容之一,应用知识产权保护民族文化传统知识是一个必要的、必然的选择。

Guizhou is a developing province in remote and backward ethnic areas. Owing to geographic and historic factors, there exist many ethnic cultural traditions.How to inherit and protect them becomes an urgent problem, On the one hand, ethnic cultural traditions, which turn out to be part of local social economy, are of great importance to develop local economy sustainably; on the other hand, these traditions, based on traditional knowledge, are distorted, split, and even abused, which have specially brought damages on their ethnic spirit and honour. Intellectual patent is an important part of WTO, so it is necessary to use intellectual patent to protect ethnic cultural traditions.
