引进外资发展旅游业的法律问题研究

Studies on legal question of importing foreign capital to develop travel industry

中国加入WTO进一步扩大了对外开放的程度,而服务行业是中国入世后首当其冲的行业,作为现代服务业的综合行业——旅游业当然是众多外商投资者所关注的重点行业了。但是由于在旅游行业基本法律、投资者法律地位、投资者合法权益保护以及对投资者的监管等方面缺乏相关的法律保障,十分不利于我国旅游业的发展。文章着重研究世界贸易组织关于服务贸易法律制度,对我国有关旅游业的法律法规进行审查和反思,并就引进外资发展我国旅游业的相关法律问题提出了若干建议。

The accession to the WTO of China has expanded the degree of opening to the outside world further, and the service industries are trades that China stands in the breach after entering the WTO , as the comprehensive trade of the modern service trade—— Travel industry is key industry that numerous foreign investor＇s paid close attention toes. But the basic law of travel industry, investor＇s legal status , protecting and supervision of investors of investor＇s legitimate rights and interests etc,which lack the relevant legal guarantee,and is very unfavorable to the development of the tourist industry of our country. So this text studies World Trade Organization about the legal system of service trade emphatically, examine and review the laws and regulations of our country＇s relevant tourist industry, and imported foreign capitalling , the relevant legal question of developing tourist industry of our country put forward several suggestions.
