民事举证妨碍规则初探

Analysis of the Principle Obstructing the Production Burden of Evidence

我国实践中广泛存在的举证妨碍行为和立法上举证妨碍制度的不足使我们对民事举证妨碍规则的探究具有积极意义。在对举证妨碍规则运行机理探析和举证妨碍行为界定的基础上,文章认为应区分不同的举证妨碍行为来规定不同的法律效果,并以此为核心建构我国的举证妨碍制度。

It＇s significant to make research on the principle obstructing the production burden of evidence because of the defected system of overcoming the phenomenon of obstructing the production burden of evidence in civil procedural law and the widely existence of such phenomenon in practice. After the Analysis of the definition and the theoretical foundation, the article argues that different solutions should be adapted to different activities of obstructing the production burden of evidence, which should be the basement for the construction of the rules of the principle obstructing the oroduction burden of evidence.
