土地承包经营权制度是我国农村土地制度的核心,学者们对土地承包经营权性质的看法各不相同。《中华人民共和国物权法(草案)》第二次审议稿将农村土地承包经营权作为用益物权加以规定,有其现实意义,但某些条文在具体制度的设计上仍然存在一些缺陷,造成承包经营权物权性的不完整。

The system of land contract managerial authority is the core of the countryside land system. Scholars have different views of the quality of the land contract managerial authority. In the second discussion of The Property Right Law of the People＇ s Republic of China （ draft ）, the land contract managerial authority in the country is prescribed as usufructuary right. It is of its realistic significance by doing so, however, some defects still exist in the specific systems of some articles, which results in the incompleteness of the property of the contract managerial authority.
