唐太宗狱政思想述评

Commentary on Ideas of Prison System of Tang Taizong Emperior

唐太宗李世民是中国历史上一位比较开明且颇有作为的封建皇帝。他在位期间,总结历史上治乱之经验教训,加强法制建设,继承并发展了传统的“德主刑辅”思想,在立法上主张礼法并用,在狱治上反对重刑酷狱,主张依法治狱、宽仁慎刑、注重教化等。唐太宗狱政思想中所蕴含的积极合理因素,对今天的狱政建设仍具有有益的启发和借鉴作用。

Li Shimin, who made great achievement, was an enlightened feudal emperior of Tang dynasty. When he was in power, he summarized the experience of putting down rebellions, and enfored the construction of legality. He also inherited and developed the traditional idea-ethic before punishment. As for establishing the law system, he proposed both ethic and law. His ideas in the respect of managing criminals were against torture, but for giving guidance in the mind and turning to the law. The reasonable factors of Li＇s ideas towards prison management are still useful and inspirable to today＇s construction of prison system.
