《龙筋凤髓判》探析

Analysis of Long Jin Feng Sui Pan——A Collection of the Cases of Judgment in Tang Dynasty

判是制判者对一个案件、事件是非曲直的判决与裁定,通常分为判目与判词两大块,张鷟的《龙筋凤髓判》便是唐代典型的拟判集之一。全书共4卷79则判文,通篇用骈体文写就,判目真实具体,判词征引繁富,最终处理意见简括明确。书中不仅反映了张鷟深厚的法学功底,而且也反映了唐高宗到玄宗开元时期人们对一些社会问题的基本看法和认识,同时从拟判角度为我们提供了了解和研究唐代科举、铨选的资料。

Long Jin Feng Sui, written by Zhang Zhuo, is a typical collection of simulated cases of judgment in Tang Dynasty. It consists of 79 cases in the style of parallel prose in four volumes in which all the cases are real and concrete, the court verdicts rich and comprehensive, the judges concise and to the point. The book provides us with the abundant materials to know the people＇s basic views about social concerns at that time and to get insight into the imperial civil examinations in Tang Dynasty. Based on the cases in the book, the author analyzes the simulated cases, their verdicts, judgments and adjudication in an all-round way with the purpose to show their application in Tang Dynasty and their real values as well.
