摘要
宪政是以人权保障为核心、以权力制约为原则的政治形态,公正审判权正体现了作为公民获得公正司法的权利,具有权利维护和权力制约价值。中国要建设宪政国家,就必须切实保护好公民的公正审判权。
Constitutional government is the polity centering on guaranteeing human rights and governed on the principle of power restriction. Just jurisdiction embodies the civic right of gaining just judicature, has rights protecting and rights restricting values. China should protect the civic just jurisdiction in order to build a country with constitutional govemment.
