浅议商标权与商号权的冲突问题

商标权与商号权之间所引起的冲突纠纷,已成为当今知识产权保护的焦点和难点问题。通过对商标权与商号权的性质、关系和冲突现状的分析,得出了产生权利冲突的主要原因。根据现有规范两者的法律制度和实践中处理两者冲突纠纷的可行做法,提出了一些解决此类权利纠纷的应对之策。

Conflicting and contrary affairs causing by service mark right and right of business name has become the focus and diffculty of intellectual asset protection. This article analyzed the characteristics, relation and conflicts of service mark right and right of business name, arrived at the principle reasons of the right conflict, gave some solutions according to the juridical system and practice about dealing with the conflict.
