摘要
为了保护受让人的合法权益,世界各国采取了不同的土地登记制度。通过对法国的公告制度、德国的土地登记簿制度以及澳大利亚的托伦斯制度等三种土地转让制度的比较法考察,法国的土地交易安全性较高,德国因土地转让纠纷引起的诉讼也很少,而澳大利亚的土地交易安全性较低,因而引发频繁的诉讼。
Different land registration systems come into operation in the world in order to protect the legal interests of the owners. Based on the study of publicity system in France, land registry system in Germany and Torrens system in Australia in the view of comparative law, the author points out the safety of land transaction in France is very high, the proceedings caused by the disputes of land transaction is very few. However, actions occur frequently in Australia because of the low safety of land transactions.
