我国环境损害责任保险制度的若干问题研究

On Constructing the Insurance System of Environmental Impairment Liabilities in China

随着我国西部大开发战略的实施,环境保护问题越来越受到重视,建立我国的环境损害责任保险制度也十分有必要。在构建我国的环境损害责任保险制度,应将突发性和渐进性污染都纳入其保险范围,针对环境侵权的危险性和持续性等因素,应采取强制保险的方式,在给予受害人赔偿时,实行责任限额制。另外,为了更好地分散保险公司的巨型环境损害责任保险的风险,要进一步推进我国再保险市场的发展,开发各种新的金融产品。

With the implement of west development strategy, China is attaching importance to the problem of environment protection, so the establish ment of the insurance system of environmental impairment liabilities becomes more important. Both sudden and gradual pollution risks should be brought into the coverage. Aiming at the fatalness and durative of the environmental infringement, we should take the compulsory insurance way. When compensations are awarded to victims, the system of proportionate limitation of the liability shall be adopted. In addition, in order to disperse the risks, we should move forward the development of Chinese reinsurance market more effectively, and exploit various kinds of financial products.
