对银行保密法律问题探讨

The Discussion on the Bank Secrecy Legal System

文章通过对我国银行保密法律制度的分析,指出对其立法中的优越之处应予继承,即对个人与单位分别运用不同的保密规定,从个人隐私、商业秘密和国家秘密三方面对银行客户的秘密进行全面的保护,同时结合保密制度发展趋势,提出相关立法建议。

By the analysis of China＇s bank secrecy legal system, the author advises to inherit its advantages in the legislation system, which means separate secrecy rules should be applied to individuals and entities. Namely the customer＇s secret should be protected roundly based on three aspects： the privacy of individual, the business secret and the state secret. Meanwhile, in view of the trend of the bank secrecy system, a few opinions are given for its legislation.
