摘要 在我国的现行立法中,未规定抵押权的追及效力,而德国、法国等国家和地区已有多种模式的立法例。我国在抵押权追及效力问题上现行立法有一些缺陷,如限制了抵押物的流转,忽略了对抵押物受让人利益的保护,使受让人的交易安全受到威胁等,与市场经济体制及现行法律相悖,应参考国外立法例,在我国未来《物权法》立法中确立抵押权追及效力及抵押物受让人的涤除权。 The current legislations of China does not specify the recourse right to mortgage. Based on the case studies of foreign legislation, the author analyzes the imperfection of current legislation of China on the issue of recourse right to mortgage, such as confining the circulation of the mortgage goods, ignoring the protection of the transferor and the acceptor, threatening their deal safety, and going against the market - oriental economy system and current law, and proposes to legislate the recourse right to mortgage and the elimination right of the transferor and acceptor in Mortgagc in the future Property Law.
