On the War Crime and Legal Responsibility

战争犯罪是现代国际法确认的国际罪行之一,对战争犯罪行为的确认和惩处是国际法和国际社会广为关注的重要问题。根据国际法中有关国际条约和国际文件关于战争犯罪的规定,从国际法发展的角度,着重分析了战争犯罪的概念及其演变,认为国际法关于战争犯罪的概念,是与其关于战争的地位以及战争主体等问题的规定密切联系的。在此基础上,探讨了构成违反战争法规和惯例的战争罪的具体犯罪行为、战争犯罪国际刑事责任的认定以及对战争罪犯个人刑事责任的追究原则等相关问题。明确战争犯罪及其法律责任,有利于国际法的发展和国际社会对战犯的有效管辖和惩治。

War crime is one of the international crimes that has been affirmed in International Law nowadays, and the affirmation and penalization of war crime are main issues concerned by the international law and international society. According to the provisions about war crime which are from international treaties and documents in international law, we stress on analyzing the concept and evolution of the war crime from the angel of the international law＇ s development, and believe that its corrupts in the international law is closely related to the provisions of the war status, war subjects and so on. Then we make a further discussion about the criminal behaviors of war crime, the recognization of international criminal responsibility of war crime, and the principles of giving criminal responsibility to war criminals.
