摘要
丝绸之路上古今各民族的习惯法,在漫长的历史发展进程中产生,适用于各民族社会生活的各个方面,成为每个民族群体意志的共同体现;并相对独立于国家法制之外,依靠某种民间权威和自选组织,来规范社会成员的行为,有时又与国家法制兼容并存。
Customary Laws in nationalities, both present and past, along the Silk Road, in their long historical development, are applied to social lives of all these nationalities and become a common embodiment of the collective will of every nationality. They are independent of national laws in that some folk authority and self-selected organizations play the role of normalize the behavior of social members. Sometimes they are compatible and coexistent with national laws.
