摘要
WTO争端解决机制未能给发展中国家成员提供公平的法律程序,经济实力不仅在磋商阶段和斡旋、调解、调停阶段发挥决定性作用,即使进入司法程序,经济实力雄厚的发达国家成员也占尽优势。贸易报复是DSU赋予发展中国家成员的最后手段,但实施贸易报复对发展中国家成员一定是得不偿失的。
The WTO mechanism of dealing with dispute Ires not afforded developing country a fair legal procedure. Economic power play a very important role in stages of consultation,mediation and intervene. Even in judicial procedure, developed countries also take the advantages. Trade reprisal is the last method of developing country which is authorized by DSU, but it must be the loss outweighs the gain.
