Analysis on The Citizen's Rights in A Constitution

多年来,宪法中的公民权一直被世人所关注,学术界对此问题也做了一些努力,但学者们对该问题的认识还有诸多的分歧。科学地界定宪法中的公民权,不仅有助于公民权利的实现,而且还有助于宪法中的公民权制度的完整性。通过对新中国宪政建设的历史回顾,思考宪法与宪政之间的关系,可根据目前的显示情况对完善宪法中公民权的必要性从多方面进行分析,可以看出对公民权的尊重与维护是宪政精神的精髓。

Scientific definition on the citizen＇ s rights in the constitution is helpful not only to the realization of the citizen＇ s rights but also to the integrity of the citizen＇s system in the constitution. In this paper the relations between the constitution and the constitutional government have been thought by the historical retrospection on the constitutional construction in China after liberation, the necessity of perfecting the citizen＇s rights in the constitution has been elaborated on the basis of the present conditions and it has been put forward that the respect of the citizen＇ s rights is the pith of the spirits of a constitutional government.
