盗窃信用卡并使用行为之定性分析——兼评《刑法》第196条第3款

The Qualitative Analysis of "Stealing Credit Card and Using It" ——A Comment about the Paragraph 3 of Article 196 of Criminal Law

盗窃信用卡并使用行为的定性问题,学界尚存争议,其争论的焦点主要在于盗窃信用卡并使用的行为是否成立盗窃罪的问题。现行立法与司法解释对此种行为的定性并不妥当,盗窃信用卡并使用的行为不构成盗窃罪,应定信用卡诈骗罪。由此,应改变《刑法》第196条第3款的的拟制规定为注意规定。

The scholars still have different opinions about the quality of “stealing credit card and using it”. The focus is whether “stealing credit card and using it” constitutes crime of larceny or not.The current legisIative and judicial interpretation about it is not advisable. “Stealing credit card and using it” does not constitute crime of larceny but crime of credit card fraud. So the paragraph 3 of article 196 of Criminal Law should be changed from a fiction of law into a notice.
