在实践中行政规范性文件制定权存在较多的失范现象,从现实和法理的角度把握这一问题,并对其进行切实有效的法律规制,以避免对相对人的利益造成侵害,是我国行政法治的一个重要内容。我国目前对行政规范性文件制定权失范的法律规制存在着诸多的问题,应在反思现有制度的基础上探索完善的路径。

There are a lot of losing-criterions of the instituting power of the administrative normative document in the practice, We should analyse this question by legal principle and from actualities. It is an important task for the administrative ruling by law of our country to regulate the losing-criterion of the instituting power of administrative normative documents effectively by law so as to avoid violating the interests of the private party in administrative process. Now there are many problems in the legal regulation for the losing-criterion. We should find out a way to perfect the existing system based on the reconsideration.
