完善我国养老保险立法的再思考

我国正处在改革社会保障制度、制定社会保障法的过程中,社会保障法的完善关系到和谐社会的构建,为此本刊特编发2005年5月12日中国人民大学劳动法和社会保障法研究所举办的“中国—法国社会保障法高级论坛”中的部分会议论文。这几篇论文深刻分析了社会保障法的价值源流和功能、我国社会保障法的现实需求以及社会保障法律制度的现状和问题,以比较和历史分析的方法提出了养老保险法律制度的改革建议,并就包括社会保障基金的融资、非法用工、生育待遇等难点问题提出了自己的见解,相信对于促进社会保障法的学术研究和制度完善具有重要的启发和借鉴价值。

Editorial note:Perfecting social security law has a bearing on the construction of harmonious society during the process of innovating social security system and establishing social security law of our country.So our journal edits several meeting articles of Advanced Forum of China-France Social Security Law which is held by Labor Law and Social Security Law Research Institute of Ren Min University of China in May 12,2005.These articles profoundly analyze value headstream and function of social security law,realistic requirement of social security law of our country and status quo and problems of social security law system.These articles provide innovation advice of insurance law system for the aged and put forward personal opinions on the difficulty problems about financing of social security fund,illegal using workers,bearing treatment by comparing and historical analysis methods.We believe that these articles have important enlighten and value of using for reference to boost academic researches and system perfecting of social security law.
