农村土地承包法之缺陷探讨

Defects with the Law on Land Contract in Rural Areas

《农村土地承包法》以法律形式赋予农民长期而又有保障的农村土地使用权,从根本上保护了农民的权利,保证农村土地承包关系的长期稳定。然而,由于种种原因,《农村土地承包法》中的确还存在着某些尚不尽如人意的地方:过多考虑了国家利益;未能较好的考虑与正在制定中的《民法典》的协调;部分具体制度设计有失全面和公允;遗漏了一些具体制度设计,等等。

According to the Law on Land Contract in Rural Areas, peasants are entitled to a long-term use of the land with security. In this sense, the Law has protected the peasants＇ rights and guaranteed stability of land contract. However, there do exist some defects with the Law including excessive attention to state benefit, lack of coordination between the Land Contract Law and the Civil Law, and unfairness of some specific articles, which are discussed in the paper.
