The Conflicts Between Confucian Ethics and Modern Law

儒家伦理曾对中国乃至东亚、东南亚产生过重要而积极的影响,然而,在中国向“依法治国,建设社会主义法治国家”的宏伟目标迈进时,这种建立在自然经济基础之上的儒家伦理规范与现代法律就不可避免地产生了严重冲突。这种冲突是多方面的,主要体现在建立基础的冲突、主体地位的冲突、治国方式的冲突、行为规则的冲突和规范内容的冲突等五个方面。

Confucian ethics had ever influenced on China, East Asia and Southeast Asia vitally and positively. However, when China enters “ruling with law to construct a socialistic lawful country”, there is great conflict between Confucian ethic norms that is based on the natural economic base and modem law inevitably. There are five aspects of the conflicts including the foundation,the status of the subject, the ruling approach, behavior norms and contents.
