摘要
行政合同是权力因素与契约精神的有效结合。由于行政合同兼具权力性与契约性,行政合同的违约责任也难免打上行政性和民事性的烙印,因而是一种相似于民事合同违约责任却又有所区别的特殊违约责任。
The attraction of administrative contract is just the effective combination of power element and contract spirit. Because administrative contract has the characteristics of both the right and the agreement, it＇s certain for administrative contract to have administrative and civil characteristics. So administrative contract is similar to the responsibility of violating a treaty in civil contract, but it＇s different from the former special one.
