国际条约生效和失效日期的特殊性使得国际刑法中的法律不溯及既往原则与国内刑法的法律不溯及既往原则有显著的差异。国际条约严格解释原则包含禁止类推解释和有利于被告的解释两重含义。国际刑法的解释主体也与国内刑法的解释主体不同。
