Formation and Establishment of Judicial System, Ideal and Technology in the Border Area of Shan, Gan and Ning

本文根据陕甘宁边区司法档案、边区政府文件、当事人日记等第一手资料,对抗日战争时期陕甘宁的司法制度、司法理念及司法技术形成的过程和基本内容进行了认真梳理,并在此基础上分析了其产生的原因与条件以及当时社会各界对其的反映和评价。本文的目的是希望上述努力能加深对我国现实司法制度,特别是司法理念的理解。

With the view of enhancing the deeper understanding to both the Chinese current judicial system and its judicial philosophy, the article manages to make a careful reorganization to the formation and the main content of the judicial system, its ideal and technology based on the judicial files, governmental documents and its party＇ s diaries in the Border Area of Shan, Gan and Ning（A name given during the War of resistance against Japan）. In addition, it also gives an detailed analysis to the reasons and conditions, the social response and comments about the generation of the ju- dicial system and its philosophy in the Border Area of Shan, Gan and Ning.
