摘要
从顺应市场经济发展要求和长期经济发展实践等方面考虑,我国创建自然人破产制度具有必要性和可行性。我国自然人破产制度在创建过程中应借鉴先进立法国家的相关立法,考虑确立许可免责制度、人格破产制度与复权制度等。
Taking into consideration of the demands and practice of the economic development of market, it is necessary and feasible to establish natural person bankruptcy system. In the process some systems such as exception permission system, personality bankruptcy system and the right resuming system, etc, should be established by using the relevant legislations in advanced countries for reference.
