论我国民事诉讼当事人举证制度的完善

Perfections about our Civil Clients Offering Evidences System

随着我国民事审判方式改革的推进,强化当事人举证已由强化当事人庭上举证到强化当事人庭上举证与庭外举证、庭审中举证与审前举证相结合的全方位举证转化,而我国现行民诉法及相关司法解释关于当事人举证制度的规定存在诸多不足,需要立法予以完善。

With the development of our country＇s civil trial patterns, strengthening the clients＇ offering evidences has been changed into the overall transformation, connecting strengthening the offering evidences at court with that outside the court, connecting strengthening the offering evidences through the trial with that before the trial. However, the clients＇ offering evidences system within our country＇s current civil procedure law and concerning judicial explanations exist some shortcomings, needing constructive amendments.
