摘要
本文以构建中国土地发展权制度为中心,从阐述国外土地发展权制度的模式及经验切入,论述中国配置土地发展权的必要性、可行性和土地发展权的法律性质;勾勒出中国土地发展权制度的基本构架:改变土地使用性质之权的土地发展权归国有,包括农用地变更为建设用地之权和未利用土地变更为农用地或建设用地之权;土地使用性质不变,但对原有土地增加投入而形成的发展权,归土地使用权人所有,包括农用地性质不变,承包人增加对农用地的投入而形成的发展权和在建设用地上进行建设而形成的发展权。
Starting from the different models of land development rights and the consequent experience overseas,this paper focuses on the legal system of China's land development rights, also discusses the necessity and feasibility of implementing land development system,and the legal characteristics of the system. This paper outlines two basic components in China's land development rights system. One is the state ownership of land development rights,including the transformation of land between farm land and land for construction,unused land and farm land or land for construction. The other is that while the nature of land use remained unchanged,new development rights stemming from new investment should belong to land users. New investments include investment by contractors to farmland and investment put into the land for construction.
