不人道是废除死刑的充足理由吗

对罪犯的人道是指对罪犯的宽容与同情,死刑之所以不人道,是因为它剥夺人的生命,使人因同情、怜悯而产生不快与不忍。在公正、效益和人道三大刑罚价值中,人道是废除死刑的惟一理由,而公正是保留死刑的惟一理由,死刑存废的矛盾体现在公正与人道的矛盾上。所以死刑是存是废必须由绝大多数人在公正与人道的心理感受上什么占优势来决定,即如果人们要求公正的感受更强烈,就应当保留死刑,要求人道的感受更强烈,则应当废除死刑。
