On Legal Construction of Shanghai International Financial Center

建设上海国际金融中心是上海市未来发展的战略规划,同时也是国家长期发展战略规划的重要组成部分。实施上海国际金融中心战略应贯彻整体规划、适度超前、与国际金融规范相协调的立法原则,其法律系统构建需要关注静态和动态两个层面。在静态层面应确保发挥基础作用的框架性法律,引导作用的放权性法律,推动作用的优惠性法律以及保障作用的监管性法律之间的统一与和谐;在动态层面应结合上海国际金融中心分步推进的发展战略,对各个阶段的法律、法规和规章的制定、修订节奏和出台时间做出系统安排。在此基础上,进一步强化金融法律意识、严格金融行政执法和规范金融司法。

Construction of Shanghai International Financial Center is a strategic plan for Shanghai's future development and an integral part of state long-term development strategy.The strategy of Shanghai International Financial Center should be carried out in accordance with the legislative principle:e.g.with an overall plan,in a moderately forward-looking manner and up to international financial standards.Its legal system should be constructed statically and dynamically.Statically,unity and harmony should be achieved between framework law,right-delegating law and preferential law on one hand and supervisory law on the other hand.Dynamically,a systemic plan should be drawn regarding the formulation of laws,policies and procedures in different stages to implement the phased development strategy of Shanghai International Financial Center.Furthermore,financial legal awareness should be enhanced and financial administration reinforced and financial judicature rationalized.
