试论我国律师职业秘密规则的完善

On the Perfection of Security Regulations for Chinese Lawyers

维护国家法律正确实施是律师全部活动的最终目的,具有根本性、终极性。在律师保守职业秘密的职责问题上,我国的现行规定明显欠缺和不完善,应进一步完善律师对委托人承担保守职业秘密的义务的规则,同时赋予律师保守职业秘密的特权,以维护委托人的合法权益。

It is lawyers＇ essential and ultimate aim to ensure the fair practice of laws. Yet there is much room for improvement in the lawyers＇ responsibility to keep the professional secrets, so the rules and regulations according to which lawyers are required to maintain secret for their clients should be perfected. Meanwhile, lawyers should be entitled to the previlege of keeping secret to ensure the clients＇ legal interests.
