《物权法》应确立公证机关为我国统一的动产抵押登记机关

Material Law Should Establish Notary Organ as the Unified Register Authority for Chattels Mortgage

本文分析了我国动产抵押登记制度存在的种种问题,指出未确立统一的动产抵押登记机关是问题的症结所在。根据《物权法》(草案)第十条、第二十六条,建立统一的动产抵押登记制度、确立统一的动产抵押登记机关势在必行。本文认为,根据《担保法》、《公证机构办理抵押登记办法》以及2005年8月28日第十届全国人民代表大会常务委员会第十七次会议通过、2006年3月1日起施行的《公证法》,确立公证机关为我国统一的动产抵押登记机关具有充足的法理基础,特别是我国公证机构不以营利为目的、依法独立行使公证职能、承担民事责任的证明机构的性质,比其他动产抵押登记机关更有利于解决现行动产抵押登记制度行政色彩浓厚的弊端,而且公证机关遍布全国各地、正在进行电子公证、网络管理的改造,确立其为统一的动产抵押登记机关具有系统改造的成本较低、减少重复建设等优越性。如果《物权法》与《公证法》能形成交集,确立公证机关为统一的动产抵押登记机关,则中国的动产抵押登记制度得以进一步的完善,中国的公证事业也将因此得到更好的发展。

This paper analyzes various problems of the system of chattels mortgage in our country, and points out the reason is that a unified register authority isn＇t established. According to the tenth and the twenty - sixth item of Material Law（draft）, it is very necessary to establish a unified register system of chattels mortgage and a unified register authority for the chattels mortgage. In the author＇ s opinion, according to Insurance Law and Way of handling mortgage register for the notary authority, and Notary Law which was passed by the seventeenth conference of the tenth National Congress of the standing committee on August 28,2005, and will came into force on March 1,2006. there is enough law foundation to establish the notary authority as a unified register authority for the chattels mortgage in our country. In particular, the notary authorities in our country never aim at benefits, but indepently exercise notary function and bear testimony of civil responsibility. Compared with other register authorities for chattels mortgage, the quality of the social intermediary organization of the notary authority in our country is easier to solve the disadvantages of the present register system for chattels mortgage, which has a deep administrative flavor. On the other hand, there are notary authorities all over the country, and they are performing electric notary and improvement of network management. Thus, there are some advantages of establishing it as a unified register authority for chattels mortgage, such as the low cost for improving the system and reducing repeat construction, if Material Law and Notary Law can mix together and establish notary orgam as the unified register authority for chattels mortgage. The register system for chattels mortgage in our country will be further improved, and the China notary will get a better development.
