摘要
《教育法》颁布以来,以其为核心,其他的相关高校管理的法律法规也陆续颁布。在这个倡导依法治教的大环境下,教育素质化、人性化、法制化成为各高校发展的目标。要实现这个目标,成人高校在管理中必须走依法行政之路。但成人高校的法律地位如何确定、高校与学生是何种法律关系、如何依法行政等诸多问题是高校在实施依法行政时所要明确的几个关键问题。
Some other laws and regulations related to the management of higher education are made and promulgated since Education Law. Under the demanding of administrating higher education according to law,the administration in higher education tends to be characterized, humanized and legalized education.In fact, administrating schools according to law is the only way to realize this plan. This paper deals with legal issues in terms of legal status, legal relation between school and students on the way ot nmnmg school according to law.
