摘要
中国行政诉讼范围的变化是中国行政法治程度的晴雨表。中国行政诉讼的范围于1989年由行政诉讼法作统一划定,但1991年最高人民法院《关于贯彻执行〈中华人民共和国行政诉讼法〉若干问题的意见(试行)》越权缩小了行政诉讼的范围,2000年最高人民法院公布的《关于执行〈中华人民共和国行政诉讼法〉若干问题的解释》恢复了行政诉讼法所规定的原本范围,与此同时,中国行政诉讼的范围在四个方面得到扩张,即教育权、抽象行政行为、不作为与教育行政案件。无论这种“扩张”是否科学适当,它毕竟代表着中国行政法治的进步!
The change in the scope of China's administrative litigation is a weatherglass showing the degree of China's administrative rule of law. The scope of law in 1989, but in 1991 it was dwindled through administrative litigation was delimited by administrative procedure the Opinions about Several Issues Involving Implementing the Administrative Procedure Law of PRC (Draft) by Supreme People's Court with undue authority. Then in 2000 it was restored through the Interpretation on Several Issues Involving Implementing Administrative Procedure Law of PRC promulgated by Supreme People's Court. At the same time, the scope of China's administrative litigation has been expanded in four aspects, i.e. cases involving right to be educated, abstract administrative act, nonfeasance, and educational administration. Such “expanding”, whether scientific and proper or not, represents the progress of China's administrative rule of law.
