我国行政补偿立法的思考

REFLECTION ON THE LEGISLATION OF ADMINISTRATIVE RECUPERATION IN CHINA

行政补偿是国家承担的有别于行政赔偿的一种赔偿责任,在一个国家的行政管理中承担重要的角色。行政补偿制度在我国的部门行政法规中已经有所体现,但成文的行政补偿的基本理论、补偿的标准和程序等问题,还没有在立法中得到确定。本文在简要回顾行政补偿制度的发展历史的基础上,分别了我国行政补偿立法的现状,并进一步提出了行政补偿立法的建议。

Administrative recuperation, a liability for compensation different from administrative compensation assumed by the government, plays a very important role in the administration. Although administrative recuperation has been embodied in administrative statutes in different services, the written basic theories, the criteria and procedures of recuperation are not yet made in the legislation. Based on a brief review of the developmental histrory of administrative recuperation and an analysis of the status quo in the legislation of the same, this paper further advances the proposals for the legislation of administrative recuperation.
