论挪用公款罪的客体规定性及故意内容

按照挪用公款罪的客体规定性,受委托管理、经营国有财产的人员实施的挪用公款行为,利用“从事劳务活动”之便实施的挪用公款行为,不为谋取私利或者不以个人名义而挪用公款的行为,都不能构成挪用公款罪。2002年4月28日立法解释第(一)项不科学。“归个人使用”只是挪用公款罪的目的要件,不是故意内容,挪用公款归个人使用的时间、数额不是故意内容,只是定罪情节。

According to the stipulation of object of the crime of misappropriating public funds, the person who manage state property by contract not by law can not commit the crime of misappropriating public funds, the person who misappropriate public funds not making use of government official business can not commit the crime of misappropriating public funds. The person who misappropriate public funds not for the purpose of private interests can not commit the crime of misappropriating public funds. The first part of interpretation by the standing committee of the national people＇ s congress on April 28,2002 is not reasonable. “For selfish use” is not the intention of the crime of misappropriating public funds. The time and amount is not the content of the intention of the crime of misappropriating public funds, they are the crime circumstances.
