摘要
关于不动产登记的效力有四种不同的模式,意思主义之下的登记不具备公示公信效力,而只是对抗第三人的要件;债权形式主义登记有其合理性,登记具有公信力,但不具有绝对的公信力;我们应采取德国式的物权形式主义登记并借鉴托伦斯登记制度的优点来完善我国的不动产登记制度,赋予登记绝对的公信力。
There are four models of the effects of real property registration, According to the representative form. registration is the important condition that does not make the property right's change effective but against the third party; On the obligation right-formalism, principle of credit in form makes the property right' s change effective, and it has the principle of public expressing and announcement, but its effect is not all real; We should take the good effects of the the property right-formalism and the registration of terrenes,in order to develop the Chinese real property registration.
