The Latest Developments in Dispute Resolution Mechanism for Individual Labors in Japan

本文就近年来日本个别劳动争议解决机制的最新发展进行了初步研究。分析了日本近年来劳动争议的现状、特征,介绍日本针对此所采取的措施;分析了日本《个别劳动争议解决促进法》、《劳动审判法》制定的背景及其内容和主要特征;最后,结合中国的现状,探讨了日本个别劳动争议解决机制对我国的借鉴意义。

This article studies the latest developments in dispute resolution mechanism for individual labors in Japan, analyzes the actualities and characteristics of labor dispute and introduces some corresponding measures that Japan has adopted in recent years. The article also analyzes Japan＇s Individual Labor Dispute Resolution Law and Labor Tribunal Law in terms of their respective preenactment histories, contents and characters. In consideration of China＇s actualities, the article finally discusses the referential significance of the mechanism to China.
